These Terms of Service ("Terms") govern your access to and use of PropertyStager.co.za and related services (the "Service") operated by PropertyStager ("we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
PropertyStager provides AI-assisted virtual staging of real-estate listing photographs. We analyse photos you upload, apply a style you select, and deliver staged images suitable for marketing a property listing.
Virtual staging is a visual enhancement only. We do not alter the physical property, and staged images must not be presented as photographs of actual furnishings or finishes in the home unless clearly disclosed.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding agreement under South African law. If you use the Service on behalf of a business (such as an estate agency), you confirm that you have authority to bind that entity to these Terms.
3. Accounts and access
- You may place an order without creating a permanent account by providing an email address at checkout.
- You may sign in using a magic link sent to your email to view order history.
- You are responsible for maintaining access to the email address associated with your orders and for keeping your gallery links confidential.
4. Orders and payment
- Pricing is displayed before you pay. The base fee is R249 per listing, which includes up to 20 photos. Additional photos are charged at R15 per photo.
- Payment is processed by a third-party payment provider. By paying, you also agree to that provider's applicable terms where relevant.
- An order is confirmed once payment is successfully received. Staging typically begins automatically after confirmation.
- Prices are in South African Rand (ZAR) unless stated otherwise. We may change pricing for future orders; changes do not affect orders already paid.
5. Your photos and responsibilities
By uploading photos, you confirm that:
- You own the photos or have permission to use them for listing marketing;
- The photos do not infringe any third-party rights (including copyright, privacy, or publicity rights);
- You will use staged outputs in compliance with applicable estate agency rules, portal guidelines, and consumer protection law;
- You will disclose virtual staging where required by your portal, regulator, or professional body.
6. Staged outputs and intellectual property
- Subject to these Terms and your payment, we grant you a non-exclusive licence to use the staged images we deliver for marketing the relevant property listing.
- We retain ownership of the Service, our branding, software, prompts, workflows, and underlying technology.
- You may not resell, sublicense, or repackage the Service itself, or use our outputs to train competing models, without our written consent.
7. Revisions and tweaks
Each staged photo includes a limited number of free tweaks (re-rolls), as displayed at checkout. Per-room restyle features may also be available from your gallery. Additional paid revisions may be introduced in future; any limits in effect at the time of your order apply to that order.
8. Acceptable use
You may not use the Service to:
- Misrepresent material features of a property (structure, size, views, condition);
- Upload unlawful, offensive, or infringing content;
- Attempt to reverse-engineer, scrape, or overload the Service;
- Circumvent payment, usage limits, or security controls;
- Use the Service for any purpose other than legitimate property marketing.
We may suspend or terminate access if we reasonably believe you have breached these Terms.
9. Service availability
We aim to deliver staged images promptly, but processing times depend on order size and system load. The Service may be unavailable from time to time for maintenance, upgrades, or factors outside our control. We do not guarantee uninterrupted or error-free operation.
10. Disclaimer
The Service is provided on an "as is" and "as available" basis. AI-generated images may occasionally contain imperfections. You are responsible for reviewing outputs before publishing them on any listing portal.
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the fullest extent permitted by South African law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, listings, business, or goodwill, arising from your use of the Service.
Our total liability for any claim relating to a specific order is limited to the amount you paid for that order.
Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for fraud or wilful misconduct.
12. Indemnity
You agree to indemnify and hold us harmless against claims, losses, and expenses (including reasonable legal fees) arising from your uploaded content, your use of staged images, or your breach of these Terms.
13. Refunds
Refunds are handled under our separate Refund Policy, which is incorporated into these Terms by reference.
14. Privacy
Our collection and use of personal information is described in our Privacy Policy.
15. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute subject to the jurisdiction of the South African courts shall be brought in a court of competent jurisdiction in South Africa, unless mandatory law provides otherwise.
16. Changes
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use after changes take effect constitutes acceptance.
